Odd.

So basically, if Democrats can hold their caucus and Republicans want to wait until Trump's out of office, we can get this done without a single one of them.

The ban vote would only take place if the impeachment resulted in conviction. They need 17 (i think) republicans to get to there.

So they'd have to vote to convict first with a 2/3 vote. Then, only if they do convict, they'd take another vote on disqualification but that only takes a 50% majority to do?

That seems odd that they could vote to convict and remove from office but then turn around and vote to allow said person to run again.

I'm not saying you're wrong, because I certainly don't know the rules. Just saying if true, the logic is strange.

It’s a logic that’s a product of the time and place in which it was written. It’s very 18th century America, wherein the number of “quality men” would have been limited. Say for example that someone like Jefferson did something to screw up as President and got impeached. Removing him from his current office as punishment would be thing, but denying him from ever engaging in any other public service is another thing. He’d still be respected enough to serve as an Ambassador or something like that.

Also, I don’t think they were anticipating how frequently or infrequently impeachment would be when they were writing it. They had no way of knowing how the government was actually going to function in practice. Perhaps impeachments would be common for all they knew.

I’d add that the 50% vote isn’t exclusively a bar from running for President, but it’s a bar to having federal office. I highly, highly doubt that “not being able to run for President again” was even really a major consideration with that clause. Elections were done differently back then and it’s highly unlikely that they’d have foreseen a scenario where someone who was successfully removed from office would have been nominated for President by their party. They didn’t have populism back then. Someone like Trump couldn’t have been President. If someone was successfully impeached then the idea that they’d ever be elected President again was likely an impossible notion.

Weird.

Meh, it’s easy to be cynical about something created by snobby Enlightenment-era elitists, but I’d say the Constitution functions pretty well for something that was written 240 years ago and the amendments, with a couple of exceptions, have all been appropriate given the changing times and evolving sensibilities of the American people. Some of these changes have come much too late, but at least we have a Constitution that can be changed. Besides, the majority of the issues don’t derive from the codes themselves, but from the American people’s implementation of those codes.

The Constitution is just a tool. It’s not the fault of the tool when idiots are wielding it.

My question is how much of this belief in "American Exceptionalism" and deification of the Constitution was real in the past? We weren't alive in 1910 or whatever to know what people actually thought about it. We're just going off a childish understanding of the past that is fed to us via Americana-porn propaganda in school. Intelligent adults like you and I are smart enough to see through that, so I'm betting most intelligent people throughout our history saw through it as well. But then again, the vast majority of people are either too stupid or don't pay enough attention to historical reality, so all they have is jingoism and so you end up with Trump's base.
